Privacy Policy
1. DEFINITIONS
“Applicable Law” shall mean any law, statute, order, decree, rule, injunction, license, permit, consent, approval, agreement and/or regulation of any government authority, and/or other legislative or administrative action of a government authority, and/or a final decree, judgment or order of a court which relates to and/or shall be rendered applicable, directly or indirectly, to the provisions of this Policy, and/or the Platform Company.
“Cookie” shall mean a small text file that is placed on the host computer or mobile device to enable various features of the Platform.
“User” shall be any person who uses the Platform.
“Personal Information” shall mean all information of the User, which has been provided to the Platform Company.
“Platform Company” shall refer to Gilda Enterprises Pvt Ltd.
“Platform” shall mean the mobile-based aggregation service for alcoholic beverages, provided by the Platform Company.
“Policy” shall refer to this Privacy Policy.
2. INTERPRETATION
In this Policy unless the context otherwise requires:
a. Words importing the singular will include the plural. Words importing the masculine gender will include the feminine or neuter and vice versa. Words importing persons will include companies.
b. Any reference in this Policy to any statue or regulation is deemed to include all amendments and revisions made from time to time to that statute or regulation and any re-enactments thereof.
c. This Policy will at all times be construed as a whole, according to its fair meaning, and not strictly for or against a party merely because that party (or the party’s legal representative) drafted the Policy.
d. The headings, titles, and captions contained in this Policy are merely for reference and do not define, limit, extend, or describe the scope of this Policy or any provision herein.
e. The word “including” means “including, without limitation.”
f. a natural person includes a juristic person and vice versa;
g. The feminine gender includes the masculine and vice versa.
3. TERMS
1. The appropriate collection, use and disclosure of the Personal Information is fundamental to the Platform Company’s day-to-day operations.
2. Protecting the privacy and the confidentiality of the Personal Information is important to the staff and employees at the Platform Company.
3. Subject to Applicable Law, every representative, agent and/or employee of the Platform Company, in the ordinary course of business, shall abide by the provisions of this Policy.
4. Each employee of the Platform Company is responsible for the Personal Information under her control.
5. The Platform Company shall obtain all its information about the User directly from him, and/or from such other person who has been duly authorized by the User to disclose such information.
6. The Platform Company uses the following types of Cookies:
6.1 Essential: The Platform Company uses cookies necessary to enable or enhance certain functionality of the Platform, such as recalling the User’s recent actions on the Platform or remembering the User’s account settings. If the User has Cookies disabled in his browser, these Cookies will be blocked.
6.2 Non-essential: The Platform Company uses Google Analytics’ cookies. If you have Cookies disabled in your browser, these Cookies will be blocked. Google Analytics is a web analysis service that is offered by Google Inc. Google Analytics uses cookies to analyse the usage of the Platform by the Customers to give the Platform Company an insight in the way User uses the Platform.
7. Under no circumstances shall the Platform Company sell any information provided by the User to third parties.
8. The Platform Company may retain the information provided by the User for, inter alia audit and verification purposes. If the information provided by the User is no longer required, it may be destroyed, at the instance of the User. However, such a deletion request needs to be provided in writing, and may come at a cost to the User.
9. The Platform Company may use the personal information of the User to send marketing and promotional activities. The End User has the right to opt out of such communication, by unsubscribing from them.
10. Access to the Personal Information shall be restricted only to the employees, agents and authorized representatives of the Platform Company, his agents and his authorized representatives, as well as the relevant sellers on the Platform from whom the User purchases any items unless the User has provided express consent to the contrary.
11. The Platform Company reserves the right to block or otherwise remove any information, including but not limited to information provided by the User on the Platform procured from any source for any reason whatsoever
12. The Platform Company reserves the right to amend this Policy unilaterally for any reason whatsoever.
13. No provision this Policy shall be applicable in case of disclosures that are mandatory under Applicable Law.
